4. SMS/Text Message Communications
4.1 Description of SMS Use Cases
By providing your mobile phone number and opting in, you expressly consent to receive the following types of recurring automated text messages (SMS and MMS) from ADAMS POOL AND SPA SERVICE LLC at the phone number you provided:
● Appointment Confirmations and Reminders: Text messages confirming your scheduled service and reminders prior to your appointment

4.2 Message Frequency and Data Rates
Message frequency varies depending on your appointments, interactions with our services, and promotional campaigns.
Message and data rates may apply. Standard messaging rates from your wireless carrier apply to all SMS and MMS messages sent to and from ADAMS POOL AND SPA SERVICE LLC. Please contact your wireless carrier for details about your messaging plan and any applicable charges. ADAMS POOL AND SPA SERVICE LLC is not responsible for any fees charged by your carrier.
You may opt out of receiving text messages at any time.
To stop receiving promotional and marketing text messages from ADAMS POOL AND SPA SERVICE LLC, simply reply STOP to any text message you receive from us. You will receive a one-time confirmation message confirming your opt-out, and no further promotional messages will be sent to that phone number unless you opt back in.
Please note that opting out of promotional messages will not affect transactional messages related to scheduled appointments you have already booked.

4.5 Carrier Liability Disclaimer
ADAMS POOL AND SPA SERVICE LLC and mobile carriers (including but not limited to AT&T, Verizon, T-Mobile, Sprint, and all other carriers) are not liable for delayed or undelivered messages.
Delivery of text messages is subject to effective transmission by your wireless carrier and network availability. Messages may be delayed or not delivered due to factors outside our control, including but not limited to: carrier network issues, device compatibility, coverage area limitations, or your device being turned off or out of range. Neither ADAMS POOL AND SPA SERVICE LLC nor any wireless carrier shall be liable for any delays, failures to deliver, or errors in the content of SMS messages.
4.6 Consent Not Required for Purchase
Your consent to receive promotional text messages is not required as a condition of purchasing any goods or services from ADAMS POOL AND SPA SERVICE LLC. You may choose not to opt in to our SMS program and still purchase our pool and spa services.

● Keep pool area clear of obstacles that may interfere with service
● Secure pets during service appointments
● Treat ADAMS POOL AND SPA SERVICE LLC staff with respect and professionalism
● Comply with all applicable laws and regulations
● Be at least 18 years of age or have a parent/guardian act on your behalf
8. Intellectual Property and Service Rights
All custom pool designs, plans, and proprietary methods remain the intellectual property of ADAMS POOL AND SPA SERVICE LLC unless otherwise agreed in writing.

9. TCPA Consent and Compliance
By providing your phone number and agreeing to these Terms, you provide your prior express written consent for ADAMS POOL AND SPA SERVICE LLC to contact you at the telephone number(s) you provide using automated technology, including automatic telephone dialing systems (ATDS), prerecorded messages, and/or artificial voice technology for the purposes described in Section 4.1 of these Terms, including both marketing and informational messages.
You understand and agree that:

To the maximum extent permitted by law, ADAMS POOL AND SPA SERVICE LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use or inability to use our services, any unauthorized access to or alteration of your data, any errors or omissions in our services, or any other matter relating to our services.
In no event shall ADAMS POOL AND SPA SERVICE LLC’s total liability to you for all claims exceed the total amount paid by you to ADAMS POOL AND SPA SERVICE LLC for the specific services giving rise to the claim.
If ADAMS POOL AND SPA SERVICE LLC cannot perform services due to fire, casualty, strike, act of God, severe weather, pandemic, or other cause beyond our control, or due to technician illness or emergency, we will make every reasonable effort to reschedule your service. If rescheduling is not possible, we will return any payments made for unperformed services, and shall have no further liability.
You agree to indemnify, defend, and hold harmless ADAMS POOL AND SPA SERVICE LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of our services, your violation of these Terms, your violation of any rights of a third party, or any content or information you provide to us.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.
