1. Acceptance of Terms
By accessing and using the services of Adam’s Pool and Spa Service (“Company,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Provided
Adam’s Pool and Spa Service provides professional pool and spa services including but not limited to:
- Commercial and residential pool cleaning and maintenance
- Pool construction and custom design
- Pool repair services (pumps, heaters, filters, motors)
- Spa installation and maintenance
- Pool chemical balancing
- Filter cleaning services
3. Service Area
Our services are available in Long Beach, Bellflower, Lakewood, Downey, Paramount, Seal Beach, Los Alamitos, Rossmoor, Westminster, Cypress, and surrounding areas in Southern California.
4. Scheduling and Appointments
- Service appointments are scheduled based on availability
- We commit to responding to all inquiries within 24 hours
- Emergency repair services are available with priority scheduling
- Clients must provide reasonable access to pool/spa equipment and property
- Rescheduling requests should be made at least 24 hours in advance when possible
5. Pricing and Payment
- Service pricing is provided through written estimates or standard rate schedules
- Payment is due upon completion of service unless other arrangements are made
- We accept cash, check, credit cards, and digital payment methods
- Late payments may incur additional fees after 30 days
- Prices are subject to change with 30 days notice for recurring service contracts
6. Warranties and Guarantees
- All repair work includes a one-year parts and labor warranty through Adam’s Pool and Spa Service
- Manufacturer warranties apply to equipment installations as specified by the manufacturer
- Jandy certified equipment installations receive extended warranty benefits
- Complete equipment package installations (pump, filter, heater) may qualify for extended warranties up to five years
- Surface installations through our NPT.com partnership include lifetime warranty coverage
- We guarantee satisfaction or your money back on all services
7. Client Responsibilities
Clients agree to:
- Provide accurate information about pool/spa systems and any existing problems
- Maintain reasonable access to service areas
- Notify us of any safety hazards or special conditions on the property
- Keep pool area clear of obstacles that may interfere with service
- Secure pets during service appointments
- Notify us immediately of any concerns with completed work
8. Liability and Insurance
- Adam’s Pool and Spa Service maintains appropriate liability insurance and contractor licensing
- We are not responsible for pre-existing conditions or damage not caused by our services
- Clients are responsible for maintaining adequate property insurance
- We are not liable for delays caused by weather, equipment availability, or circumstances beyond our control
- Maximum liability is limited to the cost of services provided
9. Cancellation Policy
- Service contracts may be cancelled with 30 days written notice
- One-time service appointments may be cancelled without penalty with 24 hours notice
- Emergency service calls may incur minimum charges if cancelled within 4 hours of scheduled arrival
- Prepaid services will be refunded on a prorated basis for unused services
10. Property Access and Safety
- Clients authorize our technicians to access pool/spa equipment areas during scheduled service times
- We follow all safety protocols and industry standards
- Clients must notify us of any hazardous conditions, aggressive pets, or access restrictions
- We reserve the right to decline service if safety conditions are inadequate
11. Intellectual Property
- All custom pool designs, plans, and proprietary methods remain the property of Adam’s Pool and Spa Service
- Clients receive usage rights for designs created specifically for their property
- Educational materials and “Pool School” content are for personal use only
12. Privacy and Confidentiality
- We maintain the privacy of client information and property access details
- Client information is used only for service delivery and communication
- We do not sell or share client information with third parties except as required by law
- Clients may request removal from marketing communications at any time
13. Dispute Resolution
- We commit to addressing any service concerns promptly and professionally
- Disputes should first be reported to our office manager at (562) 522-2203
- We will make reasonable efforts to resolve issues within 7 business days
- If resolution cannot be reached, disputes will be handled through binding arbitration in Los Angeles County, California
14. Modifications to Terms
- We reserve the right to modify these Terms of Service at any time
- Changes will be posted on our website with the updated “Last Updated” date
- Continued use of services after changes constitutes acceptance of new terms
- Major changes affecting existing contracts will be communicated directly to affected clients
15. Termination of Service
We reserve the right to terminate service relationships if:
- Payment terms are not met
- Access to property is unreasonably restricted
- Safety concerns cannot be adequately addressed
- Client behavior is abusive or threatening to our staff
- Property conditions do not meet minimum maintenance standards necessary for our services
16. Force Majeure
We are not liable for delays or failure to perform services due to circumstances beyond our control, including but not limited to natural disasters, government regulations, labor disputes, or equipment shortages.
17. Entire Agreement
These Terms of Service, along with any written service agreements or estimates, constitute the entire agreement between Adam’s Pool and Spa Service and the Client.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Governing Law
These Terms of Service are governed by the laws of the State of California. Any legal action must be brought in Los Angeles County, California.
